These Terms of Use (referred to as “Terms”) oversee your utilization of Outgoer, except in cases where we explicitly specify that distinct terms (and not these) are applicable. They also provide details about the Outgoer Service (referred to as the “Service”), which are outlined below. By creating an Outgoer account or using Outgoer, you are agreeing to abide by these terms

The Outgoer Service

We commit to providing you with the Outgoer Service. This Service encompasses all Outgoer products, features, applications, services, technologies, and software that we offer to further Outgoer's mission: To connect you with the experiences and activities you enjoy. The Service comprises the following elements:

• Creating Personalized Content, connecting, communicating, and sharing:

At Outgoer, we aim to provide personalized experiences that enable you to create, connect, communicate, discover, and share. We understand that everyone is different, so we offer various business and personal accounts that help you to express yourself, grow your presence, and engage with others both on and off Outgoer. Our goal is to enhance your relationships by facilitating shared experiences that are meaningful to you. To achieve this, we use sophisticated systems to understand your interests and those of others, allowing us to recommend content, features, offers, and accounts that you may find interesting. We strive to make your Outgoer experience enjoyable and relevant by tailoring it to your preferences and activities.

• Promoting a welcoming, diverse, and secure atmosphere.

Creating a positive, inclusive, and safe environment is paramount to us at Outgoer. We provide tools and resources to our community members to enhance their experiences, particularly when assistance is needed. Our dedicated teams and systems are committed to combating abuse, violations of our Terms and policies, and harmful or deceptive behavior. We prioritize platform security by utilizing all available information, including your data. Additionally, we may share information regarding misuse or harmful content with law enforcement agencies. • Enhancing Service Through Advanced Technologies

Our main focus is organizing and understanding information for our growing community. To achieve this, we use advanced technologies like artificial intelligence and machine learning. These technologies help us personalize, protect, and improve our service for everyone around the world. They also help us make sure our service works smoothly and stays reliable.

• Ensuring Service Accessibility

To operate our global service, we host it on Azure, Microsoft's cloud platform. This allows us to store and transfer data across our systems worldwide, including outside your country of residence. This global infrastructure is essential for providing our service.

• Personalized brand connections.

We use data from Outgoer and other sources to show you ads, offers, and sponsored content that we believe will be meaningful to you. Our aim is to make this content as relevant as all your other experiences on Outgoer.

• Research and Innovation:

We leverage information for research to enhance our service and benefit our community.

Outgoer is free for Users

Using Outgoer is free, but we show you ads from businesses and organizations that pay us to promote their products and services. We use your personal data, like your activity and interests, to show you relevant ads without revealing your identity to advertisers. We don't sell your personal data. Advertisers can target their ads based on their business goals and the audience they want to reach. We provide advertisers with reports on how their ads are performing, including general demographic and interest information about the audience. You may also see branded content from account holders who have a commercial relationship with the mentioned business partner.

The Privacy Policy

The Privacy Policy explains how we collect, use, and share information within Outgoer. It also outlines the various ways you can control your information, including through the Outgoer Privacy and Security Settings. You must agree to the Privacy Policy to use Outgoer.

Your Commitments

In return for our commitment to provide the Service, we require you to make the below commitments to us:

Who Can Use Outgoer: We want our service to be open and inclusive, but we also prioritize safety, security, and compliance with the law. Therefore, we ask you to adhere to a few restrictions to be part of the Outgoer community:

• You must be at least 18  years old or the minimum legal age in your country.
• You must not be prohibited from using our Service under applicable laws or engaging in payments-related Services if you are on an applicable denied party listing.
• Your account must not have been previously disabled by us for violation of law or any of our policies.
• You must not be a convicted sex offender.

How You Can't Use Outgoer:

To ensure a safe and positive experience for all users, there are certain ways in which you cannot use Outgoer:

• You cannot impersonate others or provide false information. Your account details must be accurate and up-to-date, and you cannot create an account on behalf of someone else without their permission.
• Engaging in unlawful, misleading, fraudulent, or unauthorized activities is not allowed. This includes violating Outgoer's terms, policies, and community guidelines.
• If you post branded content, you must comply with Outgoer's Branded Content Policies, which require the use of the branded content tool.
• You cannot disrupt or impair the functionality of the service, including abusing reporting or appeals channels.
• Unauthorized attempts to create accounts or access information are prohibited, including using automated methods without permission.
• Selling, licensing, or purchasing accounts or data obtained from Outgoer is not allowed.
• Posting private or confidential information of others without permission, or violating intellectual property rights, is prohibited.
• While you may use copyrighted works under applicable exceptions or limitations, you must own or have obtained all necessary rights to the content you post.
• Modifying, translating, creating derivative works of, or reverse engineering Outgoer's products or components is not allowed.
• Using a domain name or URL in your username without prior written consent from Outgoer is prohibited.

By using Outgoer, you grant us certain permissions to provide the service.

• You retain ownership of your content but grant us a license to use it on Outgoer. This includes the right to host, use, distribute, modify, and create derivative works of your content. The license ends when your content is deleted from our systems.
• You permit us to use your username, profile picture, and information about your interactions on Outgoer, such as likes and follows, in connection with accounts, ads, and sponsored content. This information may be displayed on Meta Products.
• You agree to allow us to download and install updates to the Outgoer app on your device.

Other Rights We Keep

• We reserve the right to change your username if we believe it is necessary, such as in cases of intellectual property infringement or impersonation.
• Additionally, while you retain ownership of your content, if you use our intellectual property in your content (such as images or videos we provide), we retain all rights to our content.
• You are only permitted to use our intellectual property and trademarks with our prior written permission.
• Lastly, you must obtain written permission from us or adhere to an open-source license to modify, create derivative works of, decompile or extract source code from our platform.

Our Agreement and Resolution Process for Disagreements

Our Agreement.

• Your use of music on the Service is governed by our Music Guidelines. You're responsible for the content you post, including any music. Commercial use of music requires proper licenses. Using videos for a music listening experience may result in content removal. Unauthorized content will be removed. Availability of music in videos may vary by country. Guidelines for video planning include using shorter music clips and ensuring a visual component. Disputes regarding content actions may be possible.
• If any part of this agreement cannot be enforced, the rest of the agreement will still apply.
• Any changes or waivers to this agreement must be in writing and signed by us.
• Our failure to enforce any part of this agreement does not mean we waive our right to enforce it in the future. We reserve all rights not explicitly given to you.

Rights Under this Agreement:

• This agreement does not confer rights to any third parties.
• You are not allowed to transfer your rights or responsibilities under this agreement without our permission.
• We can transfer our rights and obligations to others, such as in the case of a change in ownership or as mandated by law.

Responsibility for Service Interruptions and Content

• While we strive to provide our Service with care and maintain a safe environment, we cannot guarantee uninterrupted, flawless operation. We are not liable for losses not caused by our breach of these Terms, unforeseeable losses, offensive content from others, actions of others online or offline, or events beyond our control.

How We Will Handle Disputes.

If you are a consumer, the laws of your country will apply to any claim you have against us, and you can resolve it in a court in your country. Otherwise, you agree to resolve any claims exclusively by Australian laws.

Unsolicited Material:

While we value feedback and suggestions, we reserve the right to use them without any limitations or obligation to provide compensation. Additionally, we are not required to keep such submissions confidential.

Content Removal and Account Termination Policy:

We can remove any content or information you share if it violates our Terms of Use, policies, or legal requirements. We may also refuse to provide or stop providing services to you if you create risk or legal exposure for us, repeatedly infringe on intellectual property rights, or violate our terms or policies. If your account is terminated in error or you want to delete it, consult our Help Center. Deletion requests start within 30 days and may take up to 60 days to complete. During this process, your content is not visible to other users but is still subject to our Terms of Use and Data Policy. Full removal from backups may take an additional 60 days.
• Content may not be deleted within 60 days if:It has been used by others who haven't deleted i
• Technical limitations prevent deletion.
• Deletion would hinder investigations, legal obligations, or safety and security measures.

In such cases, content will be retained only as long as necessary. If your account is deleted or disabled, our agreement ends, but specific terms, including those about disputes, will still apply.

You also have the option to deactivate your account in the App settings , which will delete your data and deactivate account.

Updating These Terms:

We reserve the right to modify our Service and policies and may need to adjust these Terms accordingly to accurately reflect such changes. Unless mandated otherwise by law, we will provide you with at least 30 days' notice (e.g., through our Service) before implementing any modifications to these Terms, allowing you the opportunity to review them before their enactment. By continuing to use the Service after such updates, you agree to be bound by the revised Terms.
